1. Orders and Pricing

1.1 Order Placement

• Orders must be placed through our website or by contacting us directly at orders@daaksinc.com.
• A confirmation email or text message will be sent once the order is successfully placed.

1.2 Pricing

• All prices are listed in USD and are subject to availability. Prices may change without prior notice due to market fluctuations.
• Final pricing is confirmed at the time of order pickup.

1.3 Product Availability

• Quantities and weights are subject to availability and may vary based on market conditions or origin.
• Some items may not be available in certain seasons or may have variable master weights.

2. Payment and Billing

2.1 Payment Terms

• Payment is required upon pickup unless prior arrangements have been made.
• Acceptable payment methods include cash, credit cards, and pre-approved payment terms.

2.2 Late Payments

• Past-due balances are subject to an interest rate of 1.5% per month.

2.3 Returned Checks

• A $40 service charge applies to all returned checks.

2.4 Statutory Trust Claim

• Per the Perishable Agricultural Commodities Act (PACA), Daaks retains a trust claim over all unpaid produce, including associated inventories, receivables, and proceeds until full payment is received.

3. Order Pickup and Delivery

3.1 Pickup Terms

• Orders must be picked up at our warehouse located at 1011 Long Beach Ave., Los Angeles, CA 90021 unless otherwise specified.
• Customers are responsible for arranging transportation and verifying the order upon pickup.

3.2 Delivery (If Applicable)

• Any delivery service provided is subject to separate terms and additional fees, confirmed at the time of order placement.

4. Claims and Returns

4.1 Reporting Claims

• Claims for defective or unsatisfactory goods must be reported within 24 hours of receipt.
• All claims must be supported by a USDA inspection report or equivalent documentation.

4.2 Returns

• Returns are accepted only for items deemed defective or not meeting the agreed-upon specifications.
• Approved returns must be processed within 7 days from the date of delivery or pickup.

4.3 No Liability for Delay

• Daaks is not liable for delays caused by factors beyond our control, including transportation issues, natural disasters, or supply chain disruptions.

5. Marketing Communications

5.1 Consent to Marketing

• By providing your contact information, you consent to receiving occasional marketing communications via email and SMS regarding account updates, new produce availability, and special discounts.

5.2 Opt-Out Policy

• You may opt out of marketing communications at any time by clicking the unsubscribe link in emails or replying STOP to SMS messages.

6. Intellectual Property

6.1 Ownership

• All content on our website, including text, images, logos, and product descriptions, is owned by Daaks or licensed to us.
• You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.

6.2 Trademarks

9. Governing Law

• These Terms are governed by the laws of the State of California, excluding its conflict of law principles.
• Any disputes arising from these Terms shall be resolved exclusively in the courts located in Los Angeles County, California.
